Business Method Patents Finding Haven In Japan

In recent years Japan has gone from being one of the most difficult jurisdictions in which to get a software or business method patent to one of the easiest, says a post from IAM. Figures coming from the Japanese Patent office suggest that Japan, “in spite of its supposed faults as an ‘anti-patentee’ jurisdiction, may actually prove an easier place in which to obtain and enforce patents on technologically implemented business methods than the United States – the country which, arguably, has historically led the field in terms of this type of innovation.” This follows recent moves by China to make it easier to obtain such patents, and it suggests that corporate IP managers “will have reason to revisit their allotted budgets for the Asia-Pacific region – while tech investors may see more promise there than in software’s traditional Stateside stronghold.”
