CA Label Law Could Get Even Stricter

New proposals from the California authority that administers Proposition 65 would make the law even more onerous, according to a post from Morrison & Foerster, which has a major practice defending companies in Prop 65 litigation. MoFo attorneys say that recent proposed changes from California’s Office of Environmental Health Hazard Assessment (OEHHA) essentially negate a recent court precedent and thereby  “undermine some of the few defenses available under the Act.” The proposed changes mainly address the safe harbor provision of the law, in particular how a company is required to measure and calculate the figure it uses to express the trace amounts of certain substances, including lead and mercury, that are present in its products.
