Director Sues Guild For ACA Discrimination

The Directors Guild of America has been sued by members who claim that it violates discrimination laws under the Affordable Care Act by refusing to cover naturopathic doctors. Michael Grossman, who has directed episodes of “Legends of Tomorrow,” “Pretty Little Liars,” and “Drop Dead Divas,” among other shows, filed the suit against the DGA in August. Grossman, who turned to natural medicine after undergoing 15 surgeries for chronic medical conditions, claims that naturopathic medicine combines elements of Western and non-Western methods for managing pain, and despite seeing marked improvements, the DGA informed him in October 2014 that the health plan would not pay for his care. Grossman says that policy violates the Affordable Care Act’s prohibition against the medical care provider of the patient’s choice. The DGA filed a motion to dismiss the complaint on the basis that it is a labor organization and not a health plan. Grossman has also sued the Trustees of the DGA-Producer Health Plan, who have brought their own motion to dismiss, saying there’s no private right of action for individuals to sue under the non-discrimination provision of the ACA.
