EU Court Strikes Down Info-Sharing Deal With U.S.

The EU’s highest court this week found that the 15-year-old trans-Atlantic “Safe Harbor” pact, used by thousands of companies to protect data sharing, violates the privacy rights of Europeans by exposing them to U.S. government surveillance. Large technology companies like Apple, Google, Facebook and Microsoft had fought to preserve the flow of Europeans’ personal data to the U.S., to use in online advertising. EU law allows for other ways to transfer personal data legally, but those methods are more time-consuming as they require prior regulatory approval. Some firms have said they already prepared backup legal mechanisms to avoid clashes with regulators. “This fragmentation creates enormous legal uncertainty,” said Patrick van Eecke, a Brussels-based partner at DLA Piper.
