The FMLA Is A Fount Of Employment Litigation

A post from Foley & Lardner takes issue with an upbeat report from the Department of Labor about how the 20-year-old law is working out. While highlighting the law’s positive effect on the workforce, the DOL report also maintains the Family and Medical Leave Act has had “little to no negative impact” on employers. Not so, according to Foley. They note that the number of federal FMLA lawsuits filed more than tripled from 2012 to 2013, and the trend shows no signs of leveling off. Their conclusion is that covered employers need to pay careful attention to compliance with this law or risk being caught up in an “avalanche” of litigation.
