It Just Got Easier For Companies To Defend Against Patent Infringement Cases

In a unanimous ruling, the Supreme Court this week found that patent owners may only sue in states where they are incorporated. The ruling will have a major effect on federal courts in Eastern Texas, where more than 40 percent of patent lawsuits are now filed. Patent holders have sought out eastern Texas courts because they are known for quick trials, and juries have tended to be sympathetic to plaintiffs. The case before the Supreme Court, however, concerned an Indiana-based food sweetener company sued by Kraft Foods in Delaware. Lower courts refused to transfer the case to Indiana.
