ITC May Provide Remedy For Trade Secret Theft

Trade secret theft by foreign parties has become a massive problem for U.S. companies, but in many cases a solution is at hand. Court precedent has confirmed that U.S. law applies to importations even where the trade secret misappropriation and use occurred abroad. This means that a remedy can be sought by way of the U.S. International Trade Commission (ITC). In a recent issue of  Intellectual Property Magazine, Fitzpatrick, Cella, Harper & Scinto attorneys Stephen Belisle and Robert Pickens look at some recent ITC trade secret theft investigations and explain the elements that make a case.
