Nude Actresses And The Rule Of Reason

The Supreme Court may have finally found a case it will consider. The issue is the NCAA’s request for a review of rules prohibiting amateur athletes from licensing their names and images in game telecasts and video games. But the tension between free speech and right of publicity comes up in other contexts, including film studios’ objections to actresses being photoshopped in the nude. That is among the questions the Court could consider if it takes the case.
