Employers should take a proactive stance against harassment, says Lurie Besik of Lapidus LLP. Have a sound company policy that includes discrimination based on sex, race, color, religion, national origin, age or disability. Make sure employees are aware of the policy, and make them sign an agreement that indicates they understand it. There is a checklist about how to react to a complaint and what an investigation should cover. You may get sued anyway, Besik says, but the court will view employer efforts favorably.
