Suspension For Lawyer’s ‘Indefensibly Outrageous’ Courtroom Outburst

An Illinois lawyer’s claim that he was “baited” into a slur-laden courtroom outburst failed to convince the Review Board of the Illinois Attorney Registration and Disciplinary Commission, which upheld a six-month suspension. The review board said attorney David Alan Novoselsky engaged in “indefensibly outrageous conduct,” lobbing profanity and sexist insults at his female opposing counsel during a wrongful death lawsuit. The attorney claimed he was provoked or that it was part of courtroom banter, but witnesses said the female lawyer did nothing to provoke the comments. The review board also recommended Novoselsky be required to pay back $30,000 in unearned fees.
