Trademark Spat Stops Flow Of Cadbury Chocolate To U.S.

The settlement of a trademark lawsuit filed by The Hershey Company against Let’s Buy British, a New Jersey-based import company, means that stores in the U.S. will no longer be able to sell a number of imported UK products, including Cadbury’s Dairy Milk. Under a 1988 licensing deal, Hershey’s has manufactured Cadbury’s chocolate bar for the U.S. market using a different formula from the original UK version, and the U.S. version formula will now be the only one available this side of the Atlantic. “It is important for Hershey to protect its trademark rights and to prevent customers from being confused or misled when they see a product name or trade dress,” said a Hershey’s spokesman.
