West Hollywood Ban On Fur Survives Constitutional Challenge

A federal district court in California has dismissed a challenge to a law that bans the sale of fur products in the municipality of West Hollywood. The challenge was brought by luxury retailer Mayfair House Inc. on the grounds the law is unconstitutionally vague and arbitrary, violating both the Due Process and Equal Protection Clauses of the 14th Amendment, and also that it violated state laws preventing the city from enacting wildlife-related ordinances. In their article about the case, SheppardMullin attorneys Ted Max and Jordan Grushkin note that West Hollywood has passed a succession of groundbreaking animal rights laws over a number of years, including a ban on declawing cats and a ban on commercial display of animals, which effectively bans circuses.
