A federal judge in Delaware has leveled one of the largest spoliation sanctions recorded since last year’s changes to the federal rules, against the defendant company in an antitrust case. A senior vice president in sales at telephone headset company Plantronics was said to have been responsible for the deletion of tens of thousands of emails, in a case where Plantronics is accused of prohibiting its distributors from selling its competitors’ products to call centers. The $3 million, plus legal fees, are to be paid to the competitor-plaintiff that brought the suit.
