3M Sued for "Sham" Patent Infringement Lawsuit

A small competitor of tech giant 3M has sued the company, claiming malicious prosecution, antitrust violations and unfair competition. Plaintiff Moldex-Metric, Inc. claims that 3M filed a “sham” infringement suit in 2012 to disrupt what it perceived as a serious competitor, explains Fredrikson & Byron attorney Lora Friedemann. 3M’s motion to dismiss was rejected, and Moldex has filed a motion to seeking punitive damages on a malicious prosecution claim.
