Appeals Court Weighs Corporate Use Of RICO Law

Chevron’s convoluted lawsuit involving a case that was taken to Ecuadorian courts now poses a question before the Second Circuit Court of Appealsthat could alter how corporations are, or are not, allowed to use the Racketeer Influenced Corrupt Organizations (RICO) law. Enacted in 1970 to target mob organizations, Chevron now wants to use RICO to go after a plaintiff attorney whose lawsuit it alleges became an extortion schemes. In the two-decades long action, Chevron won a major victory last year, when a New York district court found that attorney Steve Donziger – who represented farmers and other Ecuadorians allegedly harmed by pollution caused by Chevron – violated RICO by engaging in conspiracy and criminal conduct. Previously, Donziger had won a multi-billion dollar judgement against the oil company in Ecuadorian courts.
