The writer looks at a recent Supreme Court decision, Kiobel v. Royal Dutch Petroleum, and finds it “fractured and somewhat muddy.” The question of liability under the Alien Tort Statute has not been settled, she says, and although this decision is clearly a win for transnationals, it leaves workers’ rights advocates some options.
