Comcast Lawyer Holds Legal Fees Over City’s Head

Philadelphia’s mayor should veto a bill banning employers from asking job applicants for salary histories, or else be faced with the possibility of paying huge legal fees, Comcast attorney Miguel Estrada argued. In a legal memo he wrote, “While my client and others in the business community who are considering a legal challenge do not want to appear confrontational in any way, it is important to note that a successful challenge .. could make the City liable for a substantial award of attorney’s fees.” The bill was passed 16-0 out of Philadelphia’s city council last month, and Mayor Jim Kenney has said he plans to sign it. The legislation would be the first of its kind passed by a U.S. city, and is supported by proponents who say it will help close the gender wage gap. Comcast’s challenge was drafted with the support of Greater Philadelphia Chamber of Commerce CEO Rob Wonderling.
