Controversial North Carolina Bathroom Bill Analyzed

There is a lot of misinformation around North Carolina’s bill (HB2) to protect heterosexual children from the scourge of transgender bathroom use, according to Constangy Brooks Smith & Prophete LLP’s Robin Shea, and that was before the Governor muddied the water further by mandating certain changes in the right to sue portion of it. “HB 2 does abolish the common-law ‘wrongful discharge’ cause of action based on EEO discrimination,” says Shea. “When I say ‘EEO,’ I mean discrimination based on race, sex (now “biological sex”), national origin, color, religion, age, and ‘handicap.’ (Ugh.)”
