When Cooperation With Gov’t Brings Waiver Of Privilege

McKenna Long & Aldridge attorneys look at a recent Southern District of New York decision regarding voluntary disclosure of privileged information in the course of an internal investigation, and put that decision in the context of other precedent. “We are left,” they conclude, “with a distinct impression that courts will take a dim view of privilege waiver under any voluntary disclosure and construe the constraints on such waiver narrowly, if they respect them at all.”
