CVS Sued For Exposing HIV Status Of Customers

Shelby Township, Michigan, USA - November 7, 2016: The CVS Pharmacy in Shelby Township, Michigan. CVS is the second largest chain of pharmacies in the USA with over 7,000 locations.
A federal lawsuit has been filed against CVS Health alleging that the company exposed the private health information of over 6000 individuals, including their HIV status. The Ohio Department of Health had awarded a contract to CVS, allowing it to provide individuals eligible for a drug assistance program with HIV medications. According to the suit, CVS sent out mailings in 2017 with “two clear glassine windows” revealing private health information. One window  contained the recipient’s name and address, with the designation “PM 6402 HIV” plainly visible. “The designation was not required by the Ohio Department of Health, but rather was created by CVS,” the suit alleges. It also claims that CVS hampered efforts to remediate the damage by failing to notify affected individuals and the US Department of Health and Human Services. A similar incident led to a $17 million settlement for Aetna in 2017. In that case, 12,000 individuals were affected when information about ordering prescription HIV drugs was clearly visible through an envelope’s clear window.
