EEOC Pursuing Discrimination Cases Aggressively

To some extent, the EEOC has been thwarted in its efforts to mount  so-called “systemic discrimination” cases. For example, in 2014 the agency completed fewer systemic investigations, recovered less despite more settlements, and filed fewer systemic lawsuits than it did in the previous year. Nonetheless, Today’s General Counsel columnist Barry Hartstein from the Littler firm foresees continued aggressive action by the EEOC, now that David Lopez has been approved as general counsel for a second term and the Commission is fully staffed with a 3-2 Democratic majority. He lists several key areas that employers should be watching.
