Ex-Troll Returns, Wearing White Hat & Targeting Drug Companies

Erich Spangenberg, who has been called a notorious patent troll, and J. Kyle Bass, who made his fortune as a contrarian hedge fund manager, have formed a company called the Coalition for Affordable Drugs. Their enterprise has been filing petitions for inter partes review of what they say are weak pharmaceutical industry patents, while in some cases also short-selling shares of companies that hold them. The partners maintain they are addressing pharmaceutical industry abuses, namely patents for what Spangenberg calls “zombie drugs” that are “unworthy of patent protection because they are not novel and truly innovative,” and which are “artificially kept alive to the financial detriment of patients and taxpayers.”
