Lawyers in Florida can now freely flaunt the results of past cases in television commercials or advertisements, following a U.S. District Court ruling. . The Florida Bar, which traditionally has taken a hard line on attorney advertising, arguably undercut Florida’s Supreme Court when it put limits on the ability of lawyer to advertise their victories, on the grounds “inclusion of past results in advertising carries a particularly high risk of being misleading.” But the U.S. District Court for the Southern District of Florida found the bar guidelines to be too strict, and in violation of lawyers’ commercial speech rights under the First Amendment.
