FTC Hits App Maker For Brain Claims

The FTC has concluded a settlement and consent order with Focus Education, LLC, the maker of the “Jungle Rangers” software and game. Among their claims was that the product included “scientifically proven memory and attention brain training exercises” and that it would “give your child the ability to focus, complete school work, homework and to stay on task.” Fredrikson & Byron attorney Steven E. Helland summarizes the complaint and finds it to be a clear signal that the FTC is going to be scrutinizing and is willing to regulate software or games manufacturers who say their product will improve physical or mental fitness.
