Gorsuch Sides With Employers In Workers’ Rights Cases

During his time as a federal appeals court judge, Neil Gorsuch’s worker’s rights opinions “are often sympathetic but coldly pragmatic, and they’re usually in the employer’s favor,” writes AP. Gorsuch is President Donald Trump’s nominee to the U.S. Supreme Court. Ahead of his confirmation hearings next month, AP reviewed dozens of employment cases Gorsuch oversaw on the U.S. 10th Circuit Court of Appeals. He focuses on texts, and scrutinizes definitions of words in legislation and the Constitution, AP writes, which proponents say is an appropriately strict approach and detractors say results in workers losing out. He sided with employers in 21 out of 23 times in disputes over the Employee Retirement Income Security Act. But in all of the 21 cases he was a part of the majority, which included Democrat-appointed judges as well.
