Integrating Trade Secrets Into A Comprehensive IP Strategy

At the R&D stage, the required security protections are the same no matter if a technology is going be patented or protected as a trade secret. After that, requirements diverge widely. Patents, by definition, require disclosure, but to maintain a technology or invention as a trade secret, on the contrary, it must be kept secret. That requires a well-defined and integrated strategy that includes confidentiality agreements, both internal and with third parties, and continuing employee education. Companies are also advised to carry out what the author calls “trade secret”audits” on a regular basis.
