Judge In CA Accepts Global Warming But Throws Out Global Warming Lawsuit

A federal judge in the Northern District of California – after holding an unprecedented courtroom “tutorial” on climate change – has dismissed a lawsuit targeting five big oil companies. The cities of Oakland and San Francisco, projecting massive costs as they confront the effects of sea level rise and other dislocations attributable to global warming, wanted the oil companies to be declared liable under a “public nuisance” argument. But Judge William Alsup, although he explicitly declared that he accepted the science behind global warming (as did the defendants themselves), granted the defendants’ motion to dismiss for failure to state a claim. Meanwhile, in California state court another case is going forward, this one targeting 29 oil companies, and with several cities and counties as plaintiffs.
