The court parsed the franchise contract and concluded that a Kentucky Fried Chicken franchisee loses his bid to continue advertising his chicken as halal. The plaintiff operates a number of KFC outlets in Illinois and has developed a lucrative niche selling chicken “prepared in accordance with Islamic laws and customs.” The decision explains why the company, despite the fact it had approved the sale of the halal products and actually helped the franchisee find halal producers and obtain the requisite certifications, was within its rights to change its position and forbid the products to be marketed as halal.
