In addition to understanding the technology of their client’s business, lawyers need to understand the technology that is part of their own practice. A majority of states have now adopted some version of the ABA model rule that requires lawyers to be aware of “the changes in the law and its practice, including the benefits and risks associated with relevant technology.” The need for technical competence often translates into another kind of knowledge, writes Julia Brickell in a Today’s General Counsel article: knowing when it’s necessary to enlist outside help. E-discovery and cybersecurity are two areas where this need can be critical.
