Following a series of massive high-profile data breaches at Yahoo, the general counsel resigned. In this post from D&O Diary, two cybersecurity experts, Kroll CEO David Fontaine and John Reed, president of his consulting company and former Chief of the SEC’s Office of Internet Enforcement, consider the implications of this development. “Never before,” they write, “have the consequences of a cybersecurity failure been so directly left on the general counsel’s doorstep.” The authors find three key takeaways for general counsel, starting with this takeaway #1: “The GC has emerged as the most logical and effective quarterback of data breach response.”
