The term “construction defect” covers a variety of failures, each presenting its own scenario of responsibility and possible liability. This article lays out the range of possibilities and the liabilities that may come with them. Owners, they note, often assume they are immune from liability for construction defects or failures, but that is not the case. Failure to accurately report the condition of a site preparatory to construction, for example, can be grounds for owner liability, and so too can failure to maintain after construction.
