N.M. High Court Guides Judges On Social Media

After a judge’s celebratory Facebook post was cited as one of the reasons a murder conviction was sent for retrial, New Mexico’s high court issued guidelines for judges on social media. “Members of the judiciary must at all times remain conscious of their ethical obligations,” Chief Justice Charles Daniels wrote in the decision regarding the retrial. Much of the 38-page ruling was spent discussing social media ethics, including Daniels’ recommendation that social media accounts affiliated with election campaigns be used by staff only, and that public comments on such posts be prohibited. Previous state Supreme Court advisory committee opinions on social media also stated that judges should not use pseudonyms, endorse candidates, or post reviews on sites like Yelp.
