Ohio High Court Ponders Stoned Lawyers

Lawyers in Ohio have asked the state’s Supreme Court to issue formal opinions on whether the state’s new medical laws prohibiting discipline against professionals who work with marijuana businesses or patients applies to attorneys. They’re asking the court for formal guidance on: whether Ohio attorneys may represent marijuana cultivators, processors, dispensaries, patients, and caregivers; whether lawyers may own or operate medical marijuana businesses; and whether lawyers themselves may use medical marijuana. Though Ohio’s laws now protect professional license holders from sanctions “solely for engaging in professional or occupational activities related to medical marijuana,” the Supreme Court handles attorney discipline matters, and currently prohibits lawyers from knowingly counseling or assisting a client to break the law. Though medical marijuana is legalized in Ohio, it remains illegal federally.
