A look ahead at a subject that’s been largely drowned out by more headline-conducive controversies, written by Q. Todd Dickinson, now with the Polsinelli law firm and formerly Under Secretary of Commerce for Intellectual Property and Director of the Patent and Trademark Office. He notes that the steam has gone out of several patent-related issues, including what has been called the “patent troll letter problem,” where a demand for a modest settlement is made under threat of litigation. Meanwhile, he says, other issues have come to the fore, prompted in part by the the Supreme Court’s Alice and Mayo decisions “and the growing chorus of concern regarding the USPTO’s administration of post-grant procedures.”
