Democrats in control of the House now have investigative and subpoena power. That means they have the power to call company executives to testify, and it’s certain they are going to use it. In this Today’s General Counsel article, attorneys from Hogan Lovells discuss what can be expected in this arena and how best to prepare. Among their suggestions is conducting careful research to determine what areas are likely to get the most attention and setting up a mock congressional hearing for any executive likely to be called, so that “he or she can refine this unique skill set not found in typical executive-level situations.” Included here is a checklist for companies that do receive a request.
