Recreational Pot Legal In CA, Still Banned From Workplaces

Though California voters approved a measure to legalize recreational marijuana last month, the law states that employers still have the right to enforce a drug-and-alcohol-free workplace. According to the Los Angeles Times, employment lawyers say companies are largely planning to maintain their current drug screening procedures. “The problem that California employers will have … is you have a state that that allows uses for recreational purposes, but of course you still have the federal law that makes it illegal,” Michael Kalt, partner at Wilson Turner Kosmo, told the Times. In fact, under a 2008 California Supreme Court ruling, even medical marijuana does not need to be accommodated by employers. Lawyers are advising companies to update their manuals to clarify that medical marijuana will still be a part of the drug screening process.
