Sinister Implications Of The Smiley Face

Emojis are increasingly turning up as evidence in sexual harassment and other workplace-related lawsuits. According to an article in Workforce, an online HR publication, “there are potentially sinister motives in the workplace behind an innocent emoji martini glass or kissing cat.” Because of their widespread use, employment attorneys are recommending employers review employee handbooks with an eye to making rules about emojis in office communications. A smiley face or shruggie that is acceptable in a text or Facebook post outside of work could cause problems in the workplace. Nevertheless, all companies don’t need to ban their use. Law firms, for example, may have more formal expectations for their employees, while a tech startup might consider their use as essential to the company culture.
